Common DWI Myths

Collin County DWI Attorney Separates Fact from Fiction

When it comes to facing DWI charges, you may be relying on false defenses to help your case. When you are facing penalties such as jail time, fines, and a criminal record, you cannot afford to act on faulty information. There are many mistakes which could get you arrested and charged without even deserving it. If you think you might get caught making a mistake, you cannot depend on false measures to protect you. For this reason, I want to help you understand some typical DWI myths. At The Law Office of Troy P. Myth #1: Lowering BAC through Eating and/or Waiting

If you think your blood alcohol content (BAC) can be brought down through eating, you are wrong. While eating may help you stay more focused, your BAC will remain unaffected. Waiting can help lower your BAC, but you would have to wait for more than an hour, at the very least. The body may delay the absorption of the alcohol, which means your BAC may peak a full hour after your last drink. That could be enough to land you a DWI charge, even if you started driving with a legal BAC. It is much better to rely on a designated driver.

Myth #2: Breath Spray Lowers BAC

False. Often, your breath spray will contain alcohol. You would just be spraying alcohol directly into your mouth, right where the breathalyzer is going to be measuring your BAC. Breath spray may also contain other active ingredients that would only escalate your BAC reading. Plus, if the officer smells breath spray on you, he or she can easily suspect that you are covering up something.

Myth #3: Metal, such as Pennies, in My Mouth Will Mess with a Breath Test

First off, an officer is going to make sure your mouth is empty before any test. Even if you could sneak the metal into your mouth, it would do absolutely nothing to alter what the breathalyzer measures. You may be able to find a real defense against failed breath tests with an experienced DWI attorney. There are numerous reasons why a breath test may be erroneous, and a lawyer, not a penny, can help you fight a DWI charge.

Myth #4: The Less I Cooperate with the Police, the Less They Can Use Against Me

This is a total lie. You want the police on your side. You do not want to give them, or the prosecution, any reason to suspect that you are intoxicated. If you are hostile, they will probably think you are hiding something. Be courteous, and remember that even incriminating test results can be thrown out later. Refusing to take any breath or blood tests will only get your driver's license suspended, and this can give an officer the grounds to arrest you. A prosecutor is likely to use this as well.

Myth #5: I Do Not Need an Attorney

The rest of your life could be on the line. You could be looking at years in jail or prison, hefty fines, and a stain on your record that can shadow you for the rest of your life. Consulting a few different attorneys is not going to give you the expertise that you need to defend your charges. You have the constitutional right to an attorney, and the sooner you retain one, the better your chances are. Your freedom, reputation, and future are well worth the investment.
