DWI Preliminary Hearings in Collin County

Facing Collin County DWI Charges?

After you have been arraigned for your DWI charge, the next court appearance is a preliminary hearing. This is a proceeding in which it is determined whether there is sufficient evidence to take you to trial. Both sides, the prosecution and the defense, make a presentation. During this proceeding, the judge will make a decision based on the arguments and evidence presented as to whether there is sufficient evidence in your case to take it to a trial and a jury. If you were illegally stopped by police, and this is fully established by your attorney, the case could be dismissed at this point. A well-qualified Collin County DWI attorney could be instrumental in defending the charges against you. A skilled defense could mean the difference between maximum penalties imposed upon you, the possibility of reduced charges or a dismissal.

What is a preliminary hearing?

During the preliminary hearing, the prosecution will attempt to convince the judge through evidence presented that you were driving while intoxicated. The defense will make arguments, depending upon the facts of the case, which could include challenging DWI evidence. It could be that the proof submitted is a field sobriety test, for example, and it might be established by your DWI defense lawyer that the testing was incorrectly administered. The prosecution may rely on witness testimony, and the defense can cross-examine that person, such as the law enforcement officers involved, and potentially find weaknesses or conflicts in testimony. The judge has to determine if the prosecution will be able to prove you are guilty beyond a reasonable doubt. If so, the case will then proceed to trial.
