Can a DWI Arrest Be Challenged?

Many people are unaware of the fact that neither a DWI arrest, nor a failed breath or blood test, is enough to guarantee a conviction. Before making a DWI arrest an officer is required to establish probable cause. In many cases a failed field sobriety test, a 0.08 blown on a breathalyzer test, slurred speech, the smell of alcohol on your breath or an admittance of guilt are all an officer may need before being able to place you under arrest for a suspected DWI.
