Traffic laws in Texas mandate that if you are convicted of driving while intoxicated, your license will be suspended for a period of time. If it was your first DWI conviction then you could face license suspension of up to one year, if it was your second offense then it could be suspended up to two years. If you are convicted of a third or subsequent DWI offense then you could have your driver's license suspended from 180 days to two years along with other fines and serious jail time.

Where do I go from here?
When you consult with me about your specific situation, I can help you determine your eligibility. If you declined to take the breathalyzer test, or any other chemical test, then you have 15 days to request a hearing. Even if you took the test at the time of
arrest, you are still encouraged to fight automatic license suspension in a hearing as well. For this to happen, you must submit an Administrative License Revocation Hearing (ALR) Request to the
Texas Department of Public Safety. The department will send you a letter regarding the date, time and location for the hearing, which will be conducted by the State Office of Administrative Hearings.
Usually, the hearing will be scheduled for a time within 120 days from the date the request is sent. Please note that any requests sent after the allotted time period of 15 days will automatically be considered ineligible for a hearing. If you do not request a hearing or miss the deadline, then your suspension will be effective on the 40th day after your arrest.
