Among those who have been arrested in the state for an accusation of driving while intoxicated to any degree, there are a number of mistakes that are commonly made - ten to be exact. However, your decision to work with a lawyer from my office will allow you to better avoid these mistakes, effectively bettering your chances at securing successful results for your case.

Avoid These 10 Mistakes after a DWI Arrest

  • Underestimating the seriousness of the situation. A common mistake is falsely believing that the offense is not extremely serious, when in reality nothing could be further from the truth. If not handled promptly and appropriately, a DWI charge could follow you for the rest of your life. The additional costs to your insurance alone could easily cost you thousands of dollars.
  • Waiting to hire an attorney. It is not uncommon for arrested individuals to put off hiring an attorney to see if they can defend themselves on their own or simply take the public defender to which they are legally entitled. This is a mistake of the highest proportion, as it is crucial that your lawyer be able to raise the right defenses at the right time in order to preserve your rights and freedoms. Over time, facts become unclear, memories become foggy and witnesses seemingly vanish. A case that could have been won may stand no chance if too much time elapses before hiring legal defense.
  • Hiring an attorney based on their fee alone. While the cost of an attorney can seem daunting, it does not have to. Utilizing the state's many resources, you can easily afford a reputable lawyer that is willing to put in the time and effort to your case that is necessary to yield positive results. Enlisting the help of an attorney whose fees seem too good to be true is probably just that. Practicing legal professionals need to earn enough to keep their doors open to the public, and those who offer low rates are the same attorneys who don't deliver results, as they are unable to devote the time and effort into your case that is needed to win.
  • Disobeying driver's license laws. Failure to comply with the state's laws regarding your license to drive could result in permanent revocation of your license, despite the severity - or lack thereof - of your case.
  • Continuing to drive if your license has been suspended. Again, this could result in more serious penalties.
  • Forgetting to take advantage of your constitutional rights. As stated in the U.S. Constitution, you are entitled to an attorney among other amenities if you have found yourself in trouble with the law. Taking advantage of these rights to the fullest degree will better prepare you for trial or even an out-of-court settlement.
  • Taking the first offer presented to you by a prosecutor. Hardly ever is a prosecutor's first offer a bargain. More often than not this is merely an attempt to dismiss your case having had to complete the least amount of work possible. At this stage in the game it is highly unlikely that your case will be dismissed or reduced to a non-alcoholic charge. Accepting a prosecutor's offer at this point will relinquish your ability to have a judge rule on constitutional challenges and it will effectively revoke your right to raise an issue that requires the state to prove its case.
  • Forgetting to appear in court. This will allow the court to issue a bench warrant for your arrest and even revoke any bond that may have been applicable to your case. Being stopped for a minor traffic infarction in the future will automatically land you in jail under these circumstances.
  • Talking to anyone but your attorney about your case. The old adage that anything you say can and will be used against you in the court of law is 100% true.
  • Thinking that speaking to many different attorneys will qualify you to effectively handle the case on your own. No matter how much insight you gain from your conversations with any amount of practicing attorneys, you will not have the professional knowledge and legal skill that a licensed attorney does.
